
Terms & Conditions
These Terms apply to each and every tour in which you participate. You must agree to, and comply with, these terms at all times to participate in any Sidecar Hustle tour.
Sidecar Hustle and its Guides have the authority to direct any Passenger to not participate or cease participating in any Sidecar Hustle tour if a Guide considers the Passenger to be not in compliance with these Terms, or otherwise to be acting in an unsafe manner. You must comply with such direction.
You agree to wear an approved motorcycle helmet at all times.
You represent and warrant that you meet the requirements shown on our ‘who can ride’ page.
You acknowledge and agree that motorcycle riding carries inherent risks, and that Sidecar Hustle rides are conducted on public roads that are not under the control of Sidecar Hustle.
You agree to conduct yourself in a manner that does not discredit yourself or Sidecar Hustle. Without limiting the foregoing, you agree that aggressive behaviour of any kind will not be tolerated, be it violent or abusive or erratic, directed to Guides, Passengers, other road users, or the public. If at any time a Guide determines that a Passenger fails to meet this requirement, the tour will not proceed, and a refund may not be provided. Please check our cancellation policy for details.
You give permission for Sidecar Hustle to take photos and/or video footage of you and your tour, and to use those photos and/or videos in full or any edited form for promotional and marketing purposes in print, electronic, and digital publications, including but not limited to the Sidecar Hustle website, social media platforms, and third-party media or affiliated organisations selected by Sidecar Hustle to promote its work. You waive any rights and claims, present and future, to any fees or royalties or other benefits whatsoever for or in connection with the use of the images.
Nothing in these Terms and Conditions operates to exclude, restrict or modify the application of any provision of the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any equivalent NSW legislation, the exercise of a right conferred by such a provision, or any of our liability for breach of a guarantee, condition or warranty implied by such a provision, where it is unlawful to do so. All exclusions and limitations of our liability must be read subject to this clause.
To the maximum extent permitted by law and subject to clause 5, you acknowledge and agree that Sidecar Hustle accepts no responsibility and will not be liable to you (or any third party) for any loss, cost or damage (including loss of enjoyment), except to the extent that such loss, cost or damage is a result of our negligence, fraud or wilful misconduct, suffered directly or indirectly in connection with any Sidecar Hustle tour.
To the maximum extent permitted by law and subject to clause 5, Sidecar Hustle does not assume any liability for your participation in any Sidecar Hustle tour. By participating, you agree for yourself, your heirs, executors and administrators to waive any and all claims for personal injury and/or damage that you may have against Sidecar Hustle, including its executive officers, members or representatives for any and all injuries received while taking part in any and all activities organised, sponsored, or sanctioned by Sidecar Hustle.
To the maximum extent permitted by law and subject to clause 5, Sidecar Hustle and its representatives hereby exclude any liability (including in relation to any warranty or guarantee) for any loss, damage or liability to you or your personal possessions arising out your participation in a Sidecar Hustle tour, including in respect of any death, physical or mental injury, or any aggravation, acceleration or recurrence of any condition.
To the maximum extent permitted by law and subject to clause 5, the maximum liability of Sidecar Hustle and its representatives to you for a breach of any non-excludable guarantee under the Consumer Law is limited to the resupply of the Sidecar Hustle tour price or an amount equal to the cost of the resupply of the Sidecar Hustle tour to you or your nominee.
You acknowledge that you are solely responsible for your personal possessions. You acknowledge that this is a risk warning as applicable under the NSW Civil Liability Act 2002.
You agree to indemnify Sidecar Hustle and its officers and employees for any loss, liability or costs that they may incur at any time arising or that may arise, directly or indirectly, from any act or omission by you (whether negligent or otherwise), including, but not limited to, your failure to abide by any applicable laws or your failure to otherwise abide by any information or instructions displayed on the Sidecar Hustle website, or any information given to you in any format by Sidecar Hustle.

These Terms are governed by and construed in accordance with the laws of NSW. The parties to this agreement submit to the non-exclusive jurisdiction of the Courts of NSW.
Definitions: Consumer Law means Schedule 2 of the Competition and Consumer Act 2011 (Cth), and the Civil Liability Act 2002 (NSW). Terms means these terms and conditions. ‘You’ means the person consenting to these Terms. Sidecar Hustle is a trading name of Human Enterprises Consulting Pty Ltd. All references to Sidecar Hustle have the meaning of references to Human Enterprises Consulting Pty Ltd.
Cancellation policy
We are committed to giving you a superior and reliable tour experience, but sometimes it is not possible for a tour to go ahead as planned.
This policy explains what we will do if a ride is:
cancelled by you
postponed by you
cancelled or postponed by us
terminated because you violate our terms and conditions.
Cancellation by a passenger
Once you book a ride with us, we reserve that time exclusively for you. If you cancel a booking at short notice, we may not be able to fill that time slot with another tour.
If you need to cancel your tour, notify us by email at tours@sidecarhustle.com.au. We will confirm cancellation requests by email.
If you cancel:
more than 48 hours before the tour, we will refund the tour price, less a 10% administration fee
4 to 48 hours before the tour, we will refund the tour price, less a 50% cancellation administration fee
with less than 4 hours’ notice, we cannot provide a refund.
Postponement by a passenger
If you need to postpone your tour and rebook for another time, we will do our best to help.
If you need to change your tour, notify us by email at tours@sidecarhustle.com.au. We will confirm your postponement request by email and will send you a discount code to rebook your tour at another time of your choosing.
If you ask to reschedule:
more than 48 hours before the tour, you can reschedule for free
4 to 48 hours before the tour, you can reschedule with a $20 administration fee
with less than 4 hours’ notice, we will treat your request as a cancellation.
Cancellation or postponement by Sidecar Hustle
We are committed to providing reliable tour experiences. Minor inconveniences like light rain, cold weather, or bad traffic will not stop your tour from going ahead. On rare occasions, we might need to cancel a tour because it is not safe to proceed.
If our guide decides it is not safe to ride, because of something like very bad weather or a problem with our vehicle or equipment, we will work with you to either:
reschedule the tour for a mutually agreed time
cancel the tour and provide a full refund.
We will give you as much notice as possible to reschedule or cancel a tour, but in some cases the decision may be made immediately before, or even during a tour. If we need to cancel or postpone a tour after it has started, we will give you a partial refund or rebooking proportionate to the amount of the original booking you lost.
The decision to cancel because of bad weather or mechanical issues will be at the sole discretion of the guide.
Termination
When you make a booking, you must agree to our terms and conditions. If you violate that agreement at any stage of the tour, such as by being intoxicated or not wearing appropriate clothing and safety equipment, our guide will terminate the tour immediately.
We treat termination due to violation of our terms and conditions as a cancellation without notice.
Refund processing
Refunds will be processed using the original payment method and account. We will process refunds as soon as possible, and no later than 2 business days. Refunded payments are usually received within a week of processing, but may take up to 30 days for some international payments.
